This Website is owned and operated by Art Evince Limited (registered in England and Wales with company number 12115717) whose registered office is at 16 Electric Parade, Seven Kings Road, London IG3 8BY, United Kingdom (“Art Evince”, “We”, “Us” or “Our”).
Art Evince is an online platform for viewing, selling, and buying original works of art accessible at www.artevince.com (the “Website”). We do not sell or buy the artworks displayed on the Website, but act as a commercial agent on behalf of the Seller to allow the Buyer to conclude a Contract with the Seller. We are not a party to that Contract. The only exception are the artworks displayed on the Art Evince Shop page https://artevince.com/profile/artevince, that we sell and ship directly to the buyers.
These Terms and Conditions (“Terms”) govern your access to and use of the Website and constitute a binding legal agreement between you and Art Evince. Therefore, you should read them carefully and make sure that you understand and agree to them. If you do not agree to these Terms, please do not use the Website or any of Art Evince Limited associated properties.
Ability to accept these terms
The Website is available solely to persons who are 18 or older. If you are under 18 years of age, then please do not use the Website. If you are a business customer and agree to these Terms on behalf of a legal entity, you represent and warrant that you have the authority to bind that legal entity.
Modifications to the website and to these terms
Art Evince reserves the right to modify, suspend access to or discontinue the Website, either temporarily or permanently, either with or without notice to you. Art Evince also holds the right to revise these Terms from time to time, but you will be subject to the Terms in force at the time that you use our Website. We will post the modified Terms here. If the modified Terms are not acceptable to you, your only recourse is to cease using the Website. These Terms are only available in the English language and were most recently updated on 11 September 2020.
Registration and submission of material
In order to list your artworks on our Website, you have to register an account and open your shop. After the approval of your shop, you have to click on the Sell Now button and follow the instructions. Only the selected artworks will be displayed on the Website.
In order to make a purchase through the Website, you must first create an account by completing our registration process. During the registration you will be required to provide certain information. Each person or legal entity may only register once and have one account. We reserve the right to lawfully refuse registration, or to suspend or terminate your account at our sole discretion. You may not sell, transfer, sublicense or disclose your Account credentials to any third party and agree to take sole responsibility for any activities or actions under your Account, whether or not you have authorised such activities or actions.
Art Evince uses technically reasonable efforts to display the colours of the artworks accurately. However, we cannot guarantee that your device’s display will reproduce the colours as they are intended. Art Evince is not responsible for the colour accuracy of any artwork displayed on the Website and disclaims all liability in this regard.
All artworks shown on our Website are subject to availability. Any order placed on our Website shall constitute a reservation only of the item until we are able to confirm its availability. If the Seller is unable to supply the artwork, then we will either offer you an alternative, or cancel the order. In the latter case, you will be provided with a full refund as soon as possible and in any event within fourteen days. The contract between the Buyer and the Seller is formed from the date the Buyer receives the Order Confirmation, which is when the Seller has seven (7) days to ship the artwork and the Buyer can trigger their cancellation rights.
Seller Terms and Conditions
The Seller may submit only artworks or digital prints that they have created, and they wish to sell on the Art Evince platform. The Seller should not submit any listing for artworks or digital prints that are the creation of another artist. Art Evince requires the Seller to provide all the information requested on the Sell Now page. The Seller may be required to provide a copy of a government-issued ID for identity verification. Art Evince reserves the right to edit any listings to ensure that they comply with online standards.
The Seller of the listed artworks or digital prints grants Art Evince a worldwide, transferable, non-exclusive right and license to use, reproduce, distribute, and publicly display copies of artworks or digital prints. The Seller acknowledges and agrees that the foregoing license rights are granted on a royalty-free basis.
Art Evince will be responsible for collecting billing and shipping information from the Buyer and for processing payment for such purchases via our Website. For artworks only, Art Evince will provide the Seller with the name and address of the Buyer and, unless otherwise instructed in writing by Art Evince, the Seller will be responsible for shipping the purchased artwork directly to the Buyer.
The Seller agrees to ship the purchased artwork or digital image to the Buyer within seven (7) days following the Order Confirmation (the “Shipping Period”). If you do not ship the purchased artwork or digital image to the Buyer prior to the expiration of the Shipping Period, then the sale may be cancelled. Any dates quoted for delivery of the artworks or digital prints are indicative only. Time for delivery will not be of the essence of the contract and the Seller will not be liable for any loss or expenses sustained by the Buyer arising from any delay in the delivery of the artworks or digital prints howsoever caused.
The Seller reserves the right to reject any order without the obligation to assign any reason for so doing. No order shall be deemed accepted by the Seller unless and until it is confirmed unconditionally by the Seller in the Order Confirmation. The Seller reserves the right to reject any Order based on erroneous pricing, discounts, or promotions.
Art Evince commission amounts to 25 per cent of the artwork price.
For sales of artworks via the Website, Art Evince will credit your Account in an amount equal to the asking price, the Seller required during the submission of the listing. Upon the termination of these Terms or cancellation of your Account, Art Evince will remit to the Seller the remaining balance of their Account, if any.
If you are a Seller and wish to list an artwork or digital print on the Website, the Buyer may not purchase it outside of the Art Evince platform. Violation of this clause may result in the termination of the Member accounts of the Buyer and the Seller alike, in addition to any other remedies available to Art Evince including, without limitation, injunctive or other appropriate relief.
Buyer Terms and Conditions
The Buyer may purchase artworks or digital prints that are listed on the Website. The Buyer purchases directly from the Member identified on the listing for such artwork or digital print, and not from Art Evince, except in the case of artworks sold on the Art Evince Shop page https://artevince.com/profile/artevince.
Prices for artworks and digital prints will be as specified on the listing. The Buyer acknowledges that prices do not include shipping and handling charges, or applicable taxes, if any, for which the Buyer is responsible. Art Evince will collect the Buyer’s billing and shipping information for processing the order and the payment.
If the Buyer orders artworks or digital prints from the Website for delivery outside the United Kingdom, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. The Buyer will be responsible for payment of any such import duties and taxes. Please note that Art Evince has no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
The Seller will ship the purchased artwork or digital print directly to the Buyer. The Buyer should inspect the artwork or digital print on delivery and, in case where they have been delivered by courier, sign the required proof of delivery document or collection acceptance document if required. A signature on that document will constitute conclusive evidence against the Buyer of receipt of the artwork or digital print indicated on that document free from any apparent defect or damage. If the artwork or digital print is alleged to be damaged or defective on delivery, a description of the alleged damage or defect must be given in writing at the time of delivery and signed by or on behalf of the Buyer.
If you are a Buyer and wish to purchase an artwork or digital print for which a Seller has submitted a listing, the Buyer may not purchase it outside of the Art Evince platform. Violation of this clause may result in the termination of the Member accounts of the Buyer and the Seller alike, in addition to any other remedies available to Art Evince including, without limitation, injunctive or other appropriate relief.
Art Evince reserves the right to cancel any order for an artwork of digital print placed via the Website if Art Evince determines, in its reasonable discretion, that the item is mispriced, out of stock, discontinued, or unavailable at the price listed via the Website. If Art Evince cancels an order placed via the Website, Art Evince will send to the Buyer an email confirmation of such cancellation and the Buyer will not be charged for the order.
Art Evince respects copyright law and expects its users to do the same. The Website is All Rights Reserved and no portion of the Website or its Content may be copied, retransmitted, stored, published, reproduced, or altered by any means without the prior written permission of Art Evince.
Law and jurisdiction
As between you and Art Evince, Art Evince will try and solve any disagreements quickly and efficiently. English law applies to these Terms and any sale of goods to which they apply. You agree to submit to the exclusive jurisdiction of the English courts in all matters arising from these Terms without regard to conflict of law provisions.
